Former partners BeGet and Reg.ru require to check each other

BeGet hosted by the partner’s “unfair actions” partner filed an official complaint against Reg.ru with the Coordination Center of the national domain of the Internet.

The complaint describes in detail the situation that was discussed yesterday at Habré. In short, the essence of the conflict:

According to the partnership agreement with Reg.ru, the hoster BeGet has signed agreements with customers for servicing about 70 thousand domains since 2008. Since 2016, BeGet has received accreditation and started registering domain names as an independent registrar.

On June 6, 2018, Reg.ru, without warning, disconnected the partner from accessing the API and blocked the partner account, preventing him from registering, renewing and transferring the domains of his clients, as well as ordering additional services for them.

BeGet has not yet received an official explanation from Reg.ru (the letters were sent by Post of Russia on June 2), but through unofficial channels the following was found out.

According to unofficial information received from Reg.ru employees, the termination of the contract unilaterally was caused by the violation of sub-clause b of clause 6.2.2 of the service contract between Beget LLC and Reg.ru domain name registrar LLC.

According to the contract, Reg.ru is obliged to register domain names in .ru, . and other international zones for users (customers of Beget LLC), according to the terms of the affiliate program. However, sub-clause “b” of clause 6.2.2 of the contract prohibits “the performance by the Customer of technical and other actions not covered by the Agreement, unauthorized by the Contractor, which caused or could cause damages to the Contractor to third parties” .

BeGet considers the charges baseless, untrue, and not supported by any evidence.

BeGet emphasizes that the whole ten-year term of the Agreement on the provision of services by Reg.ru did not receive any complaints, so it is illegal to refer to this circumstance to terminate the contractual relationship. In addition, BeGet denies accusations that it was misleading customers, allegedly hiding its partnership with Reg.ru.

Representatives of Beget mention several articles that Reg.ru published yesterday on various sites on the Internet. For example, see the article “REG.RU deprived the partner status of the hosting provider“ Beget ”for gross violations” on the site vc.ru.

The author of the article, Vladimir Plotnikov ( provocador ), on behalf of Reg.ru writes: “For several years, the hosting provider Beget has been our distributor. However, due to systematic violations of the terms of the agreement and the Rules for registering domain names (recently mass), operating in the national .RU / . domains, we were forced to terminate the contract. We are really concerned about the quality of work of the former partner, as well as the safety of user data (we are talking about about 50,000 clients) and serviceability of services. ”

At the moment, the company Reg.ru is preparing information to apply to the relevant control organizations in order to conduct inspections of the activities of the company “Beget” for compliance with the requirements to prevent damage to third parties. In addition, the partnership agreement with Reg.ru has clause 2.5.2:

2.5.2. The customer does not have the right to enter into agreements for the provision of services whose subject matter is identical or similar to that of this agreement with other Registrars.

It is said that this item was “pushed” into the offer on June 1, 2018.

BeGet considers Reg.ru actions unfair. According to the company, both the actions of the former partner and his statements in the media “lead not only to financial and reputational losses of Beget LLC, but also to losses and complaints from third parties.”

The main complaint is that Reg.ru sent letters to the entire BeGet client base: “At the moment, customers who have suffered from these actions ... are in a situation of misunderstanding and panic , have problems accessing their domain names and cannot manage them . For our part, we provide maximum assistance and support through all available channels of communication, but our capabilities are limited, ”the hosting provider said in a complaint.

Considering all the above, BeGet asks for an audit of the actions of Reg.ru - just as a similar test yesterday asked Reg.ru for BeGet.
